Please read these Terms of Service ("Terms", "Agreement") carefully before using the website BiharAssets.com (hereinafter referred to as the "Platform", "we", "us", or "our").
By creating an account, accessing, or using this Platform to list, discover, or source properties (including land, residential/commercial real estate, and machinery), you ("User", "You", "Buyer", "Seller", "Agent", or "Broker") explicitly agree to be bound by these Terms. If you do not agree to these Terms, you must immediately cease using the Platform.
1. Nature of Service & Intermediary Status
BiharAssets.com is purely an online peer-to-peer (P2P) classified directory and discovery platform.
Intermediary Protection:We operate as an "Intermediary" under Section 79 of the Information Technology Act, 2000 (and its subsequent amendments). We host third-party user-generated content. We do not initiate transmissions, select the receiver of transmissions, or modify the information contained in any listing.
No Real Estate Agency: BiharAssets is NOT a real estate agent, broker, property manager, valuer, or legal advisor. We do not represent either the buyer or the seller in any capacity.
2. User Accounts & Identity Verification
Eligibility: You must be at least 18 years of age and legally competent to enter into a binding contract under Indian law to use this Platform.
Verification: To maintain platform integrity and reduce spam, we require basic identity verification (such as mobile OTP verification or document uploads).
No Safety Guarantee: You explicitly acknowledge that our verification process is basic and intended solely to weed out automated bots and spam. It does NOT constitute a legal background check, character certificate, or validation of the user’s honesty. You interact with other users entirely at your own risk.
3. RERA Compliance Mandate (Critical)
The Real Estate (Regulation and Development) Act, 2016 (RERA) mandates strict rules for advertising real estate projects.
Seller/Agent Obligation: If you are a Builder, Promoter, or Agent listing a project that falls under the purview of RERA Bihar, you must provide a valid RERA Registration Number within the listing.
Platform Right to Delete: BiharAssets.com does not verify RERA numbers or audit project legalities. However, we reserve the absolute right to pull down any commercial or residential project listing instantly if it is reported or suspected to be non-compliant with RERA guidelines, without any prior notice or liability.
4. Absolute Exclusion of Liability for Financial Transactions
BiharAssets.com does not provide any integrated payment gateway for property transactions and does not participate in any monetary exchanges between users.
Outside Payments: Any payments made by a Buyer to a Seller/Agent—including but not limited to advanced tokens, booking amounts, token money (bayaana), brokerage commissions, registration fees, stamp duties, or final sale consideration—are executed strictly outside our platform.
No Indemnity for Fraud: We strictly do not track, safeguard, or hold any funds in escrow. We shall NOT be held liable for:
- Financial fraud, cheating, or embezzlement by any user.
- Cases of "Double-Selling" (where the same piece of land/property is sold or promised to multiple parties).
- Delays in property registry (daakhil-khaarij / mutation) or local municipal approvals.
- Any unauthorized brokerage demands or disputes arising from commission agreements.
5. User-Generated Content & Prohibited Items
Sellers and Agents are solely responsible for the content (text, coordinates, pricing, images, and legal descriptions) they upload.
Representations: By posting a listing, you represent and warrant that you have the complete legal right, power, and title (or a valid power of attorney/brokerage mandate) to market the said asset.
Prohibited Content: Users are strictly prohibited from posting content that:
- Infringes on any third-party intellectual property or privacy.
- Depicts government-owned land, disputed land under active court litigation (civil suits), or prohibited forest/agricultural lands without authorization.
- Is fraudulent, misleading, exaggerated, or contains fake images.
Take-Down Policy: As an intermediary, upon receiving a valid written complaint or grievance regarding an illegal or infringing listing, we will investigate and remove/disable access to such content within 36 to 72 hours in compliance with applicable IT Rules.
6. Due Diligence Obligation on Buyers
"As-Is" Sourcing:All information on BiharAssets.com is provided on an "As-Is" and "As-Available" basis.
Independent Verification: Buyers are strictly directed to perform independent, thorough legal due diligence before paying any token money. This includes verifying physical boundary demarcations, checking encumbrance certificates, and cross-verifying land records directly via the Bhumijankari / Land Revenue Department of Bihar portal or visiting the respective Registry Office (Nibandhan Karyalaya).
7. Limitation of Liability & Indemnity
Zero Liability: To the maximum extent permitted by applicable law, in no event shall BiharAssets.com, its founders, directors, employees, or affiliates be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including financial losses, loss of data, loss of business, or mental agony) arising out of or in connection with your use or inability to use the platform.
Cap on Liability: If, for any reason, a court of competent jurisdiction finds the Platform liable, our aggregate maximum financial liability to any user for any and all claims shall not exceed ₹0 (INR Zero) or the specific amount paid by the user to us for premium subscription services (if any) during the preceding 3 months.
Indemnity: You agree to indemnify, defend, and hold harmless BiharAssets.com and its team from any claims, lawsuits, legal notices, losses, or demands (including legal fees) made by any third party due to or arising out of your breach of these Terms, fake listings, or violation of any state or national law.
8. Jurisdiction & Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any legal dispute, claim, or proceeding arising out of or relating to these Terms or the use of BiharAssets.com shall be subject to the exclusive jurisdiction of the courts located at Bhagalpur, Bihar (or Patna, Bihar as applicable), to the exclusion of all other courts.
